When you have been injured on the job, you are entitled to be treated by your doctor under workers' compensation. This does not mean, however, that the insurance company is required to merely accept your doctor's opinion regarding the permanence and level of your disability.
You may be required to undergo an Independent Medical Examination (IME) by a doctor chosen by the insurance company. The independent medical examiner and your doctor may have dramatically differing opinions regarding your disability. The degree of disability is the most commonly contested issue. Is your disability temporary or permanent? Is it total or partial? If it is partial, is it mild, moderate or marked?
When conflict arises between the assessments of your disability, the options are:
- Compromising between the two positions.
- Taking the depositions of the doctors who have examined you and allowing the Workers' Compensation Board to decide.
