For workers who have been injured on the job, any changes to the laws that control workers' compensation can have a huge impact. This makes it critical that you and your attorney have the most up-to-date information available. Changes to the law can mean reduced or eliminated benefits or it may mean that some new financial resource is available to provide you with even greater support.
Workers' Compensation Changes
Some major changes to workers' compensation laws have taken place in New York between 2007 and 2010. Some of the most important changes are:
- The maximum weekly benefit has been increased and is now set at two-thirds of the state average weekly wage.
- The minimum weekly benefit has been increased.
- Cash benefits for permanent partial disabilities are now limited to a 10-year duration. Previously cash benefits for permanent partial disabilities were awarded on a lifetime basis.
