How to Appeal a Denied Disability Claim
If your claim for Social Security Disability (SSD) benefits has been denied you may feel dispirited regarding pressing your claim for benefits any further. Do not let a rejection of an initial application for SSD benefits prevent you from taking further action to press your claim. A high percentage of all initial applications are denied.
After an initial claim for SSD benefits is denied, you have 60 days to file an appeal. The Social Security Administration (SSA) and others may recommend that the most prudent step after such a denial is to reapply.
Appeals Preserve Back Benefits, Reapplying Does Not
Our firm strongly encourages those who have been denied at the initial application stage to appeal their denial. Reapplying for benefits will reset the clock regarding when benefits will begin to accumulate. An appeal preserves your date of initial application as the date on which the accrual of benefits will begin from when your claim is approved.
